1. USER OBLIGATIONS

The User is obliged, in general, to use the website canaljoyeria.com to purchase the products and services in a diligent manner, in accordance with the law, morality, public order and the provisions of these general conditions, and must also refrain from using them in any way that may prevent, damage or deteriorate the normal functioning and enjoyment of canaljoyeria.com for other users, or that may harm or cause damage to the property and rights of Almarima Surf Company SL and canaljoyeria.com, its suppliers, users or any other third party.
2. PRODUCTS AND RATES

3. HOME DELIVERY SERVICE

Delivery times according to the User's address:
* Peninsula and Balearic Islands 24-48 hours * Portugal and the Rest of the European Union 48-72 hours
The delivery time will start from 00: 00 h following the verification of the payment of the order, except Saturdays, Sundays and holidays.
In the event that the product arrives in deteriorated or defective conditions due to transport, it will be exchanged for the same product in perfect condition or similar product without any additional charge, provided that you inform us of the incident before 24 hours after receipt of the order.
3.b The home delivery service of canaljoyeria.com, is carried out in collaboration with the logistics operator chosen by Almarima Surf Company S. L.
Orders will not be served in P. O. Boxes or other non-permanent addresses.
3.c The cost of shipping is not included in the price of the products.
For deliveries in the peninsular national territory, except items in Outlet, Canary Islands, Andorra, Ceuta and Melilla, will be sent free of postage. (See section 4 for more details). For shipments of items in Outlet, Canary Islands, Andorra, Ceuta and Melilla and the Rest of Europe you can be informed of the shipping cost at the time of your purchase.
4. SHIPPING COSTS
4.a Shipping costs will be free on orders over 50€, for delivery in the national territory of the Peninsula.
Orders under 50 € will have an additional amount of 3.66 € for Cantabria, 4.50 € for the rest of the peninsula except Portugal, 7.00 € Balearic Islands, as shipping costs. We do not ship to the Canary Islands. Except shipments to, Ceuta and Melilla, Portugal , Andorra, Gibraltar and the rest of Europe that will have special treatment. All shipments outside the Peninsula will be free as long as their amount is greater than 500 €. Otherwise, they will have to pay the shipping costs.
4.b In the event that the User wishes to collect his order in our establishments of Muriedas or Solares, all of them in Cantabria, he must provide the email with the corresponding reservation and his ID. You will be given a promotional discount code for your next purchase at www.canaljoyeria.com

5. PROCEDURE AND METHOD OF PAYMENT OF THE PRODUCTS

5.c Almarima Surf Company S. L. will archive the electronic documents in which the contract is formalized, sending a copy to the user once the purchase has been made. The contract will be made in Spanish.
5.d The order confirmation sent by canaljoyeria.com it is not valid as an invoice, only as proof of purchase canaljoyeria.com send together with the item(s) and/or service (s) purchased, the ticket corresponding to it and invoice if requested.
6. RIGHT OF SUBSTITUTION OR RETURN
6.a The User has the right of substitution or refund by which he can contact Almarima Surf Company S. - According to Article 45 of the Retail Trade Law (Law 7/1996) establishes the following exceptions to the right of withdrawal. (a) Contracts for the supply of goods whose price is subject to fluctuations in financial market coefficients that the seller cannot control. b) Contracts for the supply of goods made to the consumer's specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly. c) Contracts for the supply of sound or video recordings, discs and computer programs that have been unsealed by the consumer, as well as computer files, supplied electronically, capable of being downloaded or reproduced immediately for permanent use. (d) Contracts for the supply of daily newspapers, periodicals and magazines. The Customer accepts exception a) when making any purchase in canaljoyeria.com, there being no right of withdrawal, applying only the legal right by Guarantee described in point 3 of this contract. If the Customer requests the cancellation of the order before the departure of the material from our warehouses( collection note), it will be canaljoyeria.com the decision of the origin of the refund of the amount. According to Article 44, point 3, in case of refund, the refund of the established commission amounts will not be applicable, in particular, and not only: Credit card gateway expenses, transfer issuance costs from our bank and shipping and return costs.
6.b IMPORTANT NOTICE: All engraved and/or custom-adjusted items will not be changed.
6.c Only returns that meet the following requirements will be accepted:
1-The product must be unused, in the same state in which it was delivered and must retain its original packaging and labeling. 2-The shipment must be made using the same box or envelope sent, or failing that in a similar format that guarantees the return in perfect condition. 3 - A copy of the delivery ticket must be included in the package, where the returned products and the reason for the return are also marked.
If the reason for the return is attributable to Almarima Surf Company S. L.: defective product or the order does not correspond to what was requested, the use of this service is free.
If the reason is another: the products were served correctly but for any reason no longer interested, Almarima Surf Company S. L. will pay the cost of the products except for shipping costs as mentioned in section 6.a.
6.d The right of return or replacement may not be exercised when the product is not returned in its original packaging and seal and when the product is not in perfect condition sending it to the customer and also charging the corresponding postage.
7. WARRANTIES AND CUSTOMER SERVICE
7. a All our products have the warranty specified by the manufacturer. In the event that your article presents any malfunction or deterioration, which is covered by the manufacturer's warranty, the User can proceed in the following ways, to assert the product warranty:

Almarima Surf Company S. L. is not responsible for shipping costs.
7.a. b. Bring, personally, the item to any of our establishments.
7.a. c. Send it directly to the Technical Service of the manufacturer or importer of the article. Your address and company name will be indicated in the warranty of the article itself.
7.a. d. In any establishment in your locality that works with the corresponding mark may take over the management of that guarantee.
7.b For any incident, claim or exercise of their rights, the user may send an email to the address: ventas@canaljoyeria.es
7.c If some of the information on the warranty is modified, altered or replaced or the item in question is tampered with, the warranty will lose its value.
